Welcome to [COMPANY NAME] (referred to as “we”, “us” or “our”). These Terms & Conditions (“Terms”) govern the provision of logistics, courier, parcel, transportation and related services (collectively “Services”) provided by us in India. By using our Services, making a booking, or otherwise engaging us, you agree to these Terms.
1. Definitions
Customer – the person, firm, company or other entity that books or uses our Services.
Consignment – any goods, parcels, documents or items tendered to us for transportation or delivery.
Delivery – handing over the consignment to the recipient at the specified destination or nominated delivery point.
2. Booking & Acceptance
All bookings are subject to availability and acceptance by us. A booking is confirmed only when we issue a Booking Reference / Consignment Number. We reserve the right to refuse or cancel any booking at our sole discretion (for example, if the requested service is not available, the items are prohibited, or incomplete/incorrect information is provided).
3. Rates, Taxes & Payment
- Service charges are as per our published rates or mutually agreed tariffs at the time of booking.
- All rates are exclusive of applicable taxes, duties, levies and statutory charges, which will be charged to the Customer as required by law.
- Payments must be made in the manner and within the time specified on the invoice. We may require advance payment or security for new or high-risk customers.
- Non-payment or delayed payment may result in withholding delivery, storage charges, or suspension of services.
4. Packing, Labelling & Acceptance of Consignments
The Customer is responsible for proper packing, labelling and securing of consignments. We may refuse to accept consignments that are inadequately packed, mislabeled, or present a hazard to people or property. Fragile or high-value items must be declared at booking and packed appropriately.
5. Collection, Transit & Delivery
We will use reasonable efforts to collect, transport and deliver consignments in accordance with the agreed timelines. Delivery may be to a door, counter or nominated pick-up point, depending on the Service selected. We will not be liable for delays caused by events beyond our control (see Force Majeure below).
6. Liability & Insurance
- Our liability for loss, damage or delay of consignments is limited to the declared value or the statutory limits applicable under Indian law, unless additional insurance is purchased and confirmed in writing.
- We are not liable for indirect, consequential, special or incidental losses (including business loss, loss of profits, loss of data or goodwill).
- In case of damage visible at delivery the Customer/receiver must record the damage on the proof of delivery and notify us immediately.
7. Claims, Time Limits & Documentation
All claims for loss, damage or delay must be notified to us in writing within the following time limits:
- Shortage/Damage (visible on delivery) – within 48 hours of delivery.
- Loss or non-delivery – within 7 days from the scheduled delivery date.
- Claims must be supported by original documents (booking receipt, proof of value, invoice, photos of damage, proof of delivery with notes, etc.).
Failure to comply with these timelines may result in claim rejection.
8. Prohibited & Restricted Items
Customers must not tender any items that are unlawful or dangerous. Prohibited items include (but are not limited to):
- Explosives, flammable substances, corrosives, gases, radioactive materials
- Illegal drugs, narcotics, and other contraband
- Cash, negotiable instruments, securities (unless expressly accepted in writing)
- Perishable items requiring specialized temperature control (unless prior agreement)
We may refuse or suspend carriage of restricted items unless properly documented, declared and approved. We accept no liability for consignments that contain prohibited items concealed by the Customer.
9. Customer Obligations & Indemnity
The Customer warrants that:
- The Customer is entitled to send the consignment and has provided true, complete and accurate information.
- Consignments are packaged and labelled in accordance with applicable laws and our requirements.
The Customer shall indemnify and keep us indemnified against all claims, losses, damages, costs or expenses arising from the Customer’s breach of these Terms, including claims arising from prohibited contents, incorrect documentation, or non-payment.
10. Storage & Disposal
If consignments are uncollected or delivery is refused, we may charge reasonable storage fees. After a reasonable period (and after attempting to contact the Customer/consignee), we may dispose of, auction, or destroy uncollected consignments in accordance with applicable law. Any proceeds or costs will be applied against amounts owed to us.
11. Force Majeure
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, civil commotion, government actions, strikes, pandemics, road closures, or severe weather. Where a force majeure event occurs, we will take reasonable steps to mitigate its effects and inform affected Customers.
12. Privacy & Data
We collect and process personal data necessary to provide our Services (sender/receiver contact details, address, identity proofs when required). Our use of personal data is governed by our Privacy Policy. By using our Services, you consent to the collection, use and disclosure of your data as described in that policy and as required by law (including sharing with customs, banks, law enforcement, and partners).
13. Amendments
We may amend these Terms from time to time. Updated Terms will be posted on our website with the effective date. Continued use of our Services after posting constitutes acceptance of the revised Terms.
14. Termination & Suspension
We may suspend or terminate Services for any Customer who breaches these Terms, for non-payment, unlawful activity, or if continued performance would expose us to unacceptable risk. Termination does not affect rights and liabilities accrued prior to termination.
15. Governing Law & Dispute Resolution
These Terms and any disputes arising from or relating to them shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in [State]. We encourage Customers to try to resolve disputes amicably by contacting our Customer Care before initiating legal proceedings.
16. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability in connection with any single consignment or booking shall not exceed the lesser of (a) the declared value for carriage where applicable, (b) the limits prescribed under applicable law, or (c) the total freight and service charges paid for that consignment. Under no circumstances shall we be liable for indirect, incidental, consequential, special or punitive damages.
